​A legal storm is brewing for billionaire Elon Musk and his non-governmental DOGE Committee, as a lawsuit alleging violations of federal transparency laws is set to be filed shortly after President-elect Donald Trump’s inauguration. 

The suit, launched by the public interest law firm National Security Counselors, claims that Musk’s committee is in violation of the Federal Advisory Committee Act (FACA), a 1972 law that mandates certain rules for transparency, disclosure, and hiring for advisory bodies to the executive branch, The Washington Post reported.

The allegations

The DOGE Committee, led by Musk, has come under scrutiny for allegedly failing to meet the necessary criteria for being recognized as a "federal advisory committee." According to the lawsuit, the committee’s operations lack the required transparency, particularly in areas like its hiring practices and its failure to disclose key details about its meetings. These alleged infractions are central to the lawsuit and could put the committee's legitimacy in question.

The National Security Counselors argue that, while the DOGE Committee may not technically fall under the same rules as government entities, its close association with Musk and its advisory role to the incoming administration should require it to adhere to the same FACA regulations. 

Specifically, they contend that the committee, by nature of its influence and its connections to government initiatives, must operate with more oversight.
