Court ruling keeps July layoff timeline intact
As reported by Reuters, U.S. District Judge William Orrick in Oakland, California, says Meta can continue with layoffs beginning July 22 while the workers' claims are handled in private arbitration.In a written order issued Friday, Orrick says the 26 employees do not show the kind of irreparable harm needed for an emergency order. The workers are also seeking a preliminary injunction, and the judge says during a Thursday hearing that he is likely to rule on that request next month.
The plaintiffs argue that losing their jobs would also cost them stock options and employer-backed health insurance, affecting medical care tied to pregnancies and other conditions. Meta's lawyer, Erin Connell, says the workers are losing subsidized insurance rather than all coverage, and that those losses can be compensated later if they prevail in arbitration.
AI layoff claims add new risk for workplace practices
Meta notified nearly 8,000 employees in May, about 10% of its global workforce, that they were being laid off as the company increases investment in AI. The lawsuit, filed Monday, alleges Meta used AI tools measuring productivity and AI token usage in ways that disadvantaged people absent for medical reasons or family care.The complaint says Meta also relied on performance reviews linked in part to employees' adoption of AI. According to the workers, internal systems used to score and rank employees included the large language model Metamate, an employee-trained "second brain" tracking communications and documents, and a productivity score based on keystrokes, screen content, emails and browser history.
The plaintiffs, who filed anonymously, include engineers, managers, researchers and designers. Court filings say many layoffs are set to be finalized on July 22, with others later in July or August; Meta says affected workers remain on payroll but lose access to company systems on May 20 and have not performed work since then.
The case appears to be the first against a major U.S. company challenging the alleged use of AI in carrying out layoffs. The workers say Meta's arbitration agreements require individual handling of workplace disputes, though they contend those agreements do not bar requests for temporary court relief.
