Court ruling challenges settlement structure

As reported by Financial Times, Judge Kathleen Williams ruled on Monday that Trump’s lawsuit against the IRS had no viable basis in law or fact and was filed for an improper purpose linked to a legally questionable settlement.

In a 56-page decision, Williams said the $10 billion complaint over leaked tax information amounted to self-dealing and was brought in bad faith against a federal agency that Trump oversees as U.S. president. She said the case sought to use the court to legitimize an agreement that would confer immunity on people and entities affiliated with the president and direct billions of taxpayer dollars to grievances not defined in law.

Trump reached a settlement with the IRS in May that created a $1.8 billion fund for victims of alleged weaponization and lawfare, while also giving Trump and his eldest sons, Don Jr and Eric, immunity from existing IRS tax audits. That anti-weaponization fund was later dropped, but Williams barred Trump and the government from citing the settlement in future judicial or regulatory proceedings.

The judge also said statements by acting attorney-general Todd Blanche, who declared the fund abandoned before any agreement was filed in court, showed that only one party’s interests were represented throughout the case. After initially closing the matter, Williams revisited the validity of the IRS deal following a motion from former judges and concluded there was never a genuine case or controversy and no real question about who would prevail.

Political and legal fallout widens

The ruling adds to a broader pattern of court scrutiny over the motives of Trump and his administration, and it arrives days before Blanche faces senators in a confirmation hearing. He is expected to face questions this week before the Senate judiciary committee about his ties to Trump, his former criminal defense client, and his independence from the White House.

Williams also referred one of Trump’s personal lawyers to the Florida Bar for possible disciplinary action and directed that the New York and DC Bars be informed of her ruling, where Blanche and associate attorney-general Stanley Woodward face ethics complaints. The Department of Justice did not immediately respond to a request for comment.

A spokesperson for Trump’s legal team said the IRS wrongly allowed a rogue, politically motivated employee to leak private and confidential information about the president, his family and their business, and said Trump continues to seek accountability from those who wrong America and Americans.
