U.S. Labor Department updates foreign labor certification data for FY2026 Q3
Fresh federal disclosure files expand access to employment-based immigration processing data across key visa and labor certification programs. The update covers determinations made from Oct. 1, 2025, through June 30, 2026, and adds to the Labor Department's quarterly and annual performance reporting framework.
Highlights
- The U.S. Department of Labor's Office of Foreign Labor Certification released FY2026 Q3 disclosure files covering PERM, prevailing wage, LCA, H-2A, H-2B, and CW-1 programs.
- The datasets, published in Excel, comprise unique employer submissions with selected quarterly statistics, cumulative disclosures, and historical program performance reports.
- OFLC states that disclosure files exclude ongoing cases, sensitive data, and complex information, and that post-2020 datasets feature expanded fields from updated visa forms.
FY2026 third-quarter disclosure files and scope
As reported by U.S. Department of Labor, citing the Office of Foreign Labor Certification, the latest data release includes disclosure files for PERM, prevailing wage determinations, LCA programs covering H-1B, H-1B1 and E-3, as well as H-2A, H-2B and CW-1. The datasets are published in Microsoft Excel format and draw from the agency's case management systems for nonimmigrant and immigrant applications. The Office of Foreign Labor Certification says the performance data tracks the processing of prevailing wage, labor certification and labor attestation applications. It organizes the information into selected quarterly statistics by major immigration program, cumulative quarterly and fiscal year disclosures, and historical fiscal year annual reports.
The files contain unique records identified by OFLC case number and include data submitted by employers along with related metadata. The agency says some cases can be left out of the public disclosure data when they remain in process, include personally identifiable information, or contain information that is difficult to extract in a user-friendly format.
Transparency and stakeholder use
The Labor Department presents the disclosure effort as a transparency tool for Congress, researchers and industry organizations that monitor employment-based immigration activity. At the same time, the agency says it maintains the confidentiality and integrity of employer-provided information.OFLC also notes that datasets issued after fiscal year 2020 use new layouts with additional fields tied to updated visa application forms. Users seeking broader program performance detail can also review annual reports and selected statistics in the relevant program sections of the OFLC website.
