Paramount challenges ByteDance over Seedance 2.0 AI model
US film company Paramount Skydance has sent a cease-and-desist letter to China’s ByteDance following the launch of its next-generation AI video generation model, Seedance 2.0. Other Hollywood groups and studios have also voiced solidarity in criticizing Seedance 2.0.
Hollywood organizations are opposing Seedance 2.0 by ByteDance, claiming it serves as a tool for infringing their copyrights. Paramount Skydance is the latest company to send a formal cease-and-desist demand to ByteDance, the parent company of video-streaming platform TikTok, regarding its updated generative AI model.
ByteDance launched Seedance 2.0 earlier this week, and it is currently available to Chinese users through the Jianying app. Although the company says it will soon become available globally via CapCut, the app has already faced criticism for enabling the creation of videos using images of real people as well as intellectual property owned by studios.
According to Paramount, ByteDance is committing what it calls “egregious infringement” of its intellectual property through its Seedance video platform and Seedream image generation model. The company alleges that the Chinese tech firm is unlawfully using its intellectual property, naming several characters and franchises including Dora the Explorer, South Park, Star Trek, The Godfather, and others. Paramount sent a letter on Saturday demanding that ByteDance cease the alleged infringement.
Hollywood characters move to TikTok
As reported by Cryptopolitan, the letter was sent to ByteDance CEO Liang Rubo by Gabriel Miller, Head of Intellectual Property at Paramount Skydance. In the letter, Miller stated that much of the content generated by the Seed platforms features images of well-known Paramount characters and franchises. He emphasized that these materials are protected under copyright law, trademark law, and unfair competition law.
Miller added that the content in AI-generated images and videos produced on ByteDance platforms is often indistinguishable, both visually and audibly, from Paramount’s copyrighted characters and storylines. He noted that rights related to franchises such as South Park, SpongeBob SquarePants, Star Trek, Teenage Mutant Ninja Turtles, The Godfather, Dora the Explorer, and Avatar: The Last Airbender have been “repeatedly infringed” by Seed platforms in the production and public distribution of such images and videos.
The Head of Intellectual Property also stated that the recent release of Seedance 2.0 has not only continued the alleged infringement but expanded its scale, enabling broader distribution of unlawful materials. In its letter, Paramount demanded that ByteDance prevent further violations of its intellectual property rights, ensure its content is not used or generated by ByteDance or Seed platforms in the future, and remove all instances of infringing Paramount content from its platforms and systems.
