Tokenized assets lacking equal legal rights are derivatives, Nate Geraci argues
Tokenized securities and legal rights gap

Nate Geraci emphasizes that a tokenized security must grant all the same legal rights as its traditional, non-tokenized counterpart in order to be considered a true security.

According to Geraci, if those rights are not present, the product is simply a derivative with significant counterparty risk, rather than a genuine tokenized security.

Geraci has previously engaged the crypto community to summarize the investment case for or against XRP in ten words or less. He has also highlighted major fund launches, including State Street’s introduction of the SPDR UC Investments 90/10 Endowment Strategy Index ETF with $2.5 billion in seed capital. These commentaries reflect his ongoing focus on digital assets and traditional investment products.
