Guidance revisions reflect new NSIP rules

As reported by GOV.UK, the Planning Inspectorate has updated several advice pages supporting nationally significant infrastructure projects after amendments introduced by the Planning and Infrastructure Act 2025 take effect on 24 July 2026. The changes affect how applications for NSIPs are submitted and how representations about those applications are made, while related government guidance is available through the National Infrastructure Planning Guidance Portal.

The Planning Inspectorate says its advice pages are non-statutory and are based on experience and good practice, but applicants and other participants are encouraged to follow them so the system operates effectively. The material is intended to complement legislation and formal government guidance rather than replace it.

Initial updates made in response to the new process include changes to advice on preparing and submitting application documents, including new arrangements for filing NSIP applications through the “Apply for and manage your infrastructure project” site. Revised pages also cover advice for local authorities, information on people and organisations involved in the process, the stages of the NSIP process and public participation, pre-application advice on Environmental Impact Assessment, and example documents.

The Inspectorate also replaces previous environmental guidance by withdrawing Advice note 7 on Environmental Impact Assessment and Advice note 9 on the Rochdale envelope, with the new pre-application Environmental Impact Assessment page taking their place.

Further review continues through summer

Additional affected advice pages, including the remaining pages in the environmental matters collection, are due to receive an initial update during August 2026. The Inspectorate is also carrying out a broader detailed review of its NSIP advice page collection from this summer to bring published guidance fully into line with the amended legal and policy framework.

For infrastructure developers, councils and communities involved in major project planning, the revisions signal a transition period as the updated regime is implemented. Future changes are set to be published on the Inspectorate's GOV.UK pages, giving market participants a central point for tracking operational guidance as the new framework beds in.
